Licence suspension after a DUI arrest in Pennsylvania

The licence proceeding has its own deadlines. Check the applicable notice or order, not just the criminal court date.

Hearing-request deadline in Pennsylvania: For a PennDOT license-suspension or revocation appeal to the Court of Common Pleas, the appeal must be filed within 30 days of the mailing date of PennDOT’s notice.

Deadline to request a hearing
For a PennDOT license-suspension or revocation appeal to the Court of Common Pleas, the appeal must be filed within 30 days of the mailing date of PennDOT’s notice.
  • This is the court-appeal period for the PennDOT licensing sanction, not a period measured from the DUI arrest or the date the notice is received.
  • PennDOT’s manual identifies the Court of Common Pleas (Civil Division) in the driver’s county of residence. This is distinct from the criminal case.
  • The notice’s mailing date controls this stated appeal period; the sanction’s listed effective date is a separate date. This answer does not establish that filing automatically restores driving privileges.

Hearing procedure under the cited rule
Judicial review: appeal PennDOT's licensing action to the court with jurisdiction under Title 42. Serve the department's legal office with a copy of the appeal petition and the notice being appealed.
  • This is a court appeal of the licensing action, not a request for an agency administrative hearing and not the criminal case itself.
  • Section 1550 does not state the driver's appeal-filing deadline. Its 60-day provision concerns written notice to PennDOT of the court hearing; it is not the driver's filing window.
  • Filing and service ordinarily stay a suspension or revocation until the court's final determination, but subsection (b) contains exceptions for specified licensing actions, further court review and commercial-driving disqualifications. A filing alone does not establish permission to drive.

What happens if the window closes

The effect of a missed hearing-request deadline depends on the proceeding and the applicable law. This page does not determine whether review is still available or whether a particular licence restriction applies. A defence lawyer can review the notice or order and explain the available procedures.

Whether Pennsylvania offers a restricted licence in that situation, and on what conditions, is a state-specific question:

Hardship or restricted licence

Ignition interlock, first offense

How the two cases relate

A licence restriction may arise from a test result, a refusal or a criminal conviction. Those are not interchangeable grounds. The source and conditions attached to each rule matter; this page does not predict how one proceeding will affect another in a particular case.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.
