DUI law in Pennsylvania
The criminal charge and your driving privileges are separate questions. Check both.
DUI law in Pennsylvania concerns both the criminal charge and the right to drive. The applicable licence process depends on the alleged conduct, test result or refusal, and the notice or court order. A criminal court date is not a substitute for checking a separate licence deadline. The cited rules below identify what has been verified for this jurisdiction.
The two legal questions
The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

- For a PennDOT license-suspension or revocation appeal to the Court of Common Pleas, the appeal must be filed within 30 days of the mailing date of PennDOT’s notice.
- This is the court-appeal period for the PennDOT licensing sanction, not a period measured from the DUI arrest or the date the notice is received.
- PennDOT’s manual identifies the Court of Common Pleas (Civil Division) in the driver’s county of residence. This is distinct from the criminal case.
- The notice’s mailing date controls this stated appeal period; the sanction’s listed effective date is a separate date. This answer does not establish that filing automatically restores driving privileges.

- Judicial review: appeal PennDOT's licensing action to the court with jurisdiction under Title 42. Serve the department's legal office with a copy of the appeal petition and the notice being appealed.
- This is a court appeal of the licensing action, not a request for an agency administrative hearing and not the criminal case itself.
- Section 1550 does not state the driver's appeal-filing deadline. Its 60-day provision concerns written notice to PennDOT of the court hearing; it is not the driver's filing window.
- Filing and service ordinarily stay a suspension or revocation until the court's final determination, but subsection (b) contains exceptions for specified licensing actions, further court review and commercial-driving disqualifications. A filing alone does not establish permission to drive.
