DUI law in Oklahoma

The criminal charge and your driving privileges are separate questions. Check both.

DUI law in Oklahoma concerns both the criminal charge and the right to drive. The applicable licence process depends on the alleged conduct, test result or refusal, and the notice or court order. A criminal court date is not a substitute for checking a separate licence deadline. The cited rules below identify what has been verified for this jurisdiction.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

Deadline to request a hearing
District-court appeal: within 30 days after Service Oklahoma mails the revocation notice under § 753 or § 754.
  • Section 6-211(E) measures this filing period from mailing of the notice under § 2-116, not from the date the driver receives it.
  • This is a petition to the district court for review of a test-refusal or test-result revocation under § 753 or § 754. It is not a request for an agency hearing.
  • The court’s separate 30-to-60-day hearing-setting period runs from filing the petition. It is not the driver’s filing deadline, and the statute does not require final disposition within that period.

Hearing procedure under the cited rule
For a § 753 or § 754 revocation, review is by petition to the district court in the county of arrest, with certified-mail service on Service Oklahoma.
  • The petition must be filed within 30 days after Service Oklahoma mails the revocation notice. Section 6-211(E) specifies the information the petition must contain.
  • The court enters an order setting a hearing. A certified copy of the petition and hearing order must be served promptly on Service Oklahoma by certified mail.
  • A hearing may include a status hearing or scheduling conference; it need not be the final determination of the appeal.
  • Under subsection J, Service Oklahoma’s receipt of the petition triggers withholding or staying the challenged action. Driving privileges during the appeal remain conditional on the person otherwise being eligible; filing alone is not an assurance of permission to drive.
