DUI law in New Jersey

The criminal charge and your driving privileges are separate questions. Check both.

DUI law in New Jersey concerns both the criminal charge and the right to drive. The applicable licence process depends on the alleged conduct, test result or refusal, and the notice or court order. A criminal court date is not a substitute for checking a separate licence deadline. The cited rules below identify what has been verified for this jurisdiction.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

Hearing procedure under the cited rule
A refusal proceeding under N.J. Stat. § 39:4-50.4a is decided by the municipal court. The court determines whether the statutory refusal elements are established and orders the applicable licensing consequences.
  • This answer concerns the refusal proceeding under §39:4-50.4a, not a general request to the Motor Vehicle Commission to review a proposed suspension.
  • The statute directs the court to address the officer’s probable cause, arrest where appropriate, and refusal of the requested test. This summary is not an exhaustive account of defenses or case-law requirements.
  • A separate MVC notice must be evaluated under its own governing rules. This section does not supply a general MVC hearing-request deadline.
