DUI law in Kentucky

The criminal charge and your driving privileges are separate questions. Check both.

DUI law in Kentucky concerns both the criminal charge and the right to drive. The applicable licence process depends on the alleged conduct, test result or refusal, and the notice or court order. A criminal court date is not a substitute for checking a separate licence deadline. The cited rules below identify what has been verified for this jurisdiction.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

Deadline to request a hearing
For a pretrial suspension under KRS 189A.200, the court must conduct judicial review within 30 days after the motion for review is filed. Section 189A.200(2) does not state a numerical deadline for filing that motion.
  • The 30-day period is the court’s review period after filing, not a deadline requiring the driver to request review within 30 days of arrest or suspension.
  • This answer concerns the court-ordered pretrial suspension procedure in KRS 189A.200. It does not establish that no other deadline or court requirement can apply.

Hearing procedure under the cited rule
A person whose license is suspended under KRS 189A.200 may file a motion for judicial review of the suspension with the court. The court must advise the defendant of the right to review when it orders the suspension.
  • This is judicial review of a court-ordered pretrial suspension, not a general request for an agency administrative hearing.
  • The court must conduct the review under Chapter 189A within 30 days after the motion is filed. That review period is not a 30-day filing deadline.
