DUI law in Kansas

The criminal charge and your driving privileges are separate questions. Check both.

DUI law in Kansas concerns both the criminal charge and the right to drive. The applicable licence process depends on the alleged conduct, test result or refusal, and the notice or court order. A criminal court date is not a substitute for checking a separate licence deadline. The cited rules below identify what has been verified for this jurisdiction.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

Deadline to request a hearing
The ordinary request period is 14 days after service of the officer's certification and suspension notice.
  • The request is written, with separate mailing/postmark and fax-receipt requirements. Mail-service and statutory time-computation rules can affect the deadline; use the actual notice and current Kansas Department of Revenue instructions.

Hearing procedure under the cited rule
Request a Kansas driver’s-license hearing in writing by mail or fax. The hearing is by phone unless you ask for an in-person hearing in the same request.
  • This process applies after service of the officer’s certification and suspension notice under K.S.A. 8-1002. The ordinary request period is 14 days after service—not after arrest. Mailing uses a postmark requirement; a fax must reach the division within the request period. Mail-service and time-counting rules can affect the deadline.
  • A request for the certifying officer to attend must also be made when requesting the hearing. An in-person hearing is held in the county of arrest or a neighboring county.
  • This is the administrative case about driving privileges, separate from the criminal case. Check the suspension notice for the submission instructions; appearing in criminal court does not replace the hearing request.
