The licence case
Licence suspension after a DUI arrest in Hawaii
The licence proceeding has its own deadlines. Check the applicable notice or order, not just the criminal court date.
Hearing-request deadline in Hawaii: For the initial hearing schedule, the director must receive the hearing request within 6 days of the date the administrative review decision is mailed.
Hawaii HB2417 CD1 / Act 71 (2026) (opens in a new tab)The notice identifies your proceeding. Conditions below.
The window
- Deadline to request a hearing
- For the initial hearing schedule, the director must receive the hearing request within 6 days of the date the administrative review decision is mailed.
- This follows an administrative review affirming the revocation. The six-day period runs from mailing of that review decision, not from the arrest or the original revocation notice.
- A separate late-hearing route allows a request within 60 days of issuance of the original notice of administrative revocation. That is a different trigger, not an extension of the six-day period from the review decision.
- Hearing procedure under the cited rule
- Request an administrative hearing from the director. The written review decision must explain the request procedure and include a postage-paid form that may be completed and mailed to request the hearing.
- The request concerns administrative license revocation. Use the procedure supplied with the written review decision; the initial hearing schedule requires receipt within six days of mailing of that decision.
- Act 71 (2026) preserves a separate late-hearing request within 60 days of issuance of the original revocation notice. Do not treat the review-decision date and original-notice date as interchangeable.

What happens if the window closes
The effect of a missed hearing-request deadline depends on the proceeding and the applicable law. This page does not determine whether review is still available or whether a particular licence restriction applies. A defence lawyer can review the notice or order and explain the available procedures.
Whether Hawaii offers a restricted licence in that situation, and on what conditions, is a state-specific question:
- Hardship or restricted licence
- An eligible driver may obtain an ignition-interlock permit during administrative revocation after proving installation and compliant insurance.
- Not everyone qualifies: separate license suspensions or expirations, lack of a valid license at arrest, learner permits and commercial-license restrictions affect eligibility. The section also provides a separate employer-vehicle permit process.
- Ignition interlock, first offense
- Not published yet. We show a figure only once it has been confirmed against the official source and dated.
How the two cases relate
A licence restriction may arise from a test result, a refusal or a criminal conviction. Those are not interchangeable grounds. The source and conditions attached to each rule matter; this page does not predict how one proceeding will affect another in a particular case.
The two legal questions
The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

- Surcharges and assessment/treatment requirements are additional. Highly intoxicated drivers and adult drivers with a passenger younger than 15 face added penalties.
- Interlock permits have eligibility restrictions. The statute provides conditional early termination and a separate rule for a person unable to install an interlock or drive.
