Licence suspension after a DUI arrest in Georgia

The licence proceeding has its own deadlines. Check the applicable notice or order, not just the criminal court date.

Hearing-request deadline in Georgia: 30 calendar days from issuance or service of the 1205/1205S notice of intent to suspend; the appeal must be received or postmarked within that period.

Deadline to request a hearing
30 calendar days from issuance or service of the 1205/1205S notice of intent to suspend; the appeal must be received or postmarked within that period.
  • This deadline applies to administrative licence or implied-consent suspensions under O.C.G.A. § 40-5-67.1. It is tied to the notice—not a general deadline measured from arrest or a criminal-court date.
  • The rule requires a complete, signed hearing request and a $150 nonrefundable filing fee. A timely date alone does not make an incomplete request sufficient.
  • Missing the appeal deadline ordinarily waives the hearing. If DDS decides that the request was untimely, the rule separately allows a written reconsideration request received or postmarked within five calendar days after that decision, with supporting documentation. This is not an automatic extension of the original deadline.

Hearing procedure under the cited rule
Georgia DDS accepts administrative licence-suspension hearing requests online, by mail or at a DDS Customer Service Center.
  • DDS requires a complete hearing request and payment of the appropriate fees within the applicable appeal period. Its guidance warns that an incomplete or late request will be rejected and the right to appeal waived.
  • For licensed drivers, the online route is through Online Services, then Other Services and the Hearing Request option. Mailing addresses depend on the reason for appeal; DDS lists the addresses on its official instructions.
  • Attorneys have a separate online hearing-request route and may also submit by mail or at a Customer Service Center.
  • This DDS instruction page does not state a numeric appeal deadline. The request methods do not extend the applicable filing period.

What happens if the window closes

The effect of a missed hearing-request deadline depends on the proceeding and the applicable law. This page does not determine whether review is still available or whether a particular licence restriction applies. A defence lawyer can review the notice or order and explain the available procedures.

Whether Georgia offers a restricted licence in that situation, and on what conditions, is a state-specific question:

Hardship or restricted licence

Ignition interlock, first offense

How the two cases relate

A licence restriction may arise from a test result, a refusal or a criminal conviction. Those are not interchangeable grounds. The source and conditions attached to each rule matter; this page does not predict how one proceeding will affect another in a particular case.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.
