Testing and evidence

Implied consent and refusal in Georgia

The test requested, legal grounds and applicable statute matter.

Implied-consent laws connect driving and chemical testing under specified legal conditions. The test requested and the officer’s legal grounds matter. The source-checked rules available for Georgia appear below. A missing suspension figure is not a statement that refusal has no consequences. Check the applicable notice and official provision.

Roadside tests and chemical tests are different things

Identify what was requested: a field sobriety exercise, a roadside screening test, or a chemical test of breath, blood or urine. Do not assume the same refusal rule applies to all of them. The relevant statute, any warrant, and the circumstances of the request determine the legal question for a lawyer to review.

The two legal questions

The criminal charge and driving privileges can involve different proceedings. The notice, order and cited rule identify the applicable process.

Deadline to request a hearing
30 calendar days from issuance or service of the 1205/1205S notice of intent to suspend; the appeal must be received or postmarked within that period.
  • This deadline applies to administrative licence or implied-consent suspensions under O.C.G.A. § 40-5-67.1. It is tied to the notice—not a general deadline measured from arrest or a criminal-court date.
  • The rule requires a complete, signed hearing request and a $150 nonrefundable filing fee. A timely date alone does not make an incomplete request sufficient.
  • Missing the appeal deadline ordinarily waives the hearing. If DDS decides that the request was untimely, the rule separately allows a written reconsideration request received or postmarked within five calendar days after that decision, with supporting documentation. This is not an automatic extension of the original deadline.
